Residency Status Criteria for Japan Business Manager Visa

Foreign nationals residing in Japan under the “Business Manager Visa” residency status are required to properly manage their businesses. The organizations they operate (including sole proprietorships) must comply with laws and regulations regarding the fulfillment of various public obligations as follows:

(1) Compliance with Tax Laws and Regulations

National taxes (income tax, corporate tax, etc.) and local taxes (resident tax, business tax, etc.) must be paid appropriately. Even if no penalties have been imposed for failure to fulfill tax obligations, failure to fulfill such obligations—such as in cases where significant arrears or prolonged non-payment are discovered—will be evaluated as a negative factor.

(2) Compliance with Labor and Social Insurance Laws and Regulations

The working conditions of all employees (including part-time workers) must comply with labor laws and regulations. If the business is subject to labor insurance, it is required to properly complete the enrollment procedures for such insurance and pay premiums appropriately. If the business is subject to Health Insurance and Pension, it is required to have completed the enrollment procedures for these insurance programs, to have processed the eligibility acquisition procedures for employees under these programs, and to be paying premiums appropriately. Failure to comply with these labor and social insurance laws and regulations will be evaluated as a negative factor.
